Das belgische Parlament hat bekannt gegeben, dass der Gesetzesentwurf f\u00fcr die obligatorische elektronische Rechnungsstellung im B2B-Bereich<\/a> in Belgien ver\u00f6ffentlicht wurde. Das bedeutet, dass das Mandat ab dem 1. Januar 2026 anwendbar ist und angenommen werden kann. Obwohl eine Ausnahmeregelung der Europ\u00e4ischen Kommission (EU-Richtlinie Artikel 218 und 232) noch erforderlich ist, wird erwartet, dass sie im Einklang mit ViDA erscheinen wird.<\/p>\n\n\n\n

PEPPOL-basierte elektronische Rechnungsstellung f\u00fcr Belgien<\/h2>\n\n\n\n

Die Strategie des Landes f\u00fcr die elektronische Rechnungsstellung im B2B-Bereich umfasst zwei Stufen – 1) die auf PEPPOL basierende Struktur der elektronischen Rechnungsstellung zwischen Steuerzahlern – 4-Ecken-Modell 2) erweitert um die Vorabkl\u00e4rung mit den Steuerbeh\u00f6rden (Continuous Transaction Control, CTC) – 5-Ecken-Modell. <\/p>\n\n\n\n

Das 4-Ecken-Modell sieht zun\u00e4chst keine direkte staatliche Berichterstattung vor. Im gegenseitigen Einvernehmen k\u00f6nnen jedoch auch andere B\u00f6rsenplattformen genutzt werden, sofern sie den Anforderungen der EU entsprechen. Mit dem 5-Ecken-Modell strebt Belgien eine langfristige strategische Planung an, zu der auch eine zeitnahe elektronische Berichterstattung geh\u00f6rt, die den j\u00e4hrlichen Bericht \u00fcber die Auflistung der Verk\u00e4ufe ersetzt. Au\u00dferdem wird dies dazu beitragen, die Mehrwertsteuerl\u00fccke<\/a> und die Differenz zwischen prognostizierter und eingenommener Steuer zu verringern. Nach Angaben der EU wird die j\u00fcngste belgische Mehrwertsteuerl\u00fccke f\u00fcr das Jahr 2023 auf rund 2,5 Mrd. \u20ac pro Jahr gesch\u00e4tzt.<\/p>\n\n\n\n

Das Ziel der elektronischen B2B-Rechnungsstellung in Belgien<\/h2>\n\n\n\n

Belgien strebt in erster Linie eine Synchronisierung mit den Pl\u00e4nen der EU VAT in the Digital Age f\u00fcr das System der elektronischen Rechnungsstellung – EN 16931 – in der gesamten Region an, um Interoperabilit\u00e4t zu gew\u00e4hrleisten. Im Rahmen der S\u00e4ule der digitalen Meldepflicht plant die EU eine verbindliche, strukturierte elektronische Rechnungsstellung f\u00fcr innergemeinschaftliche Lieferungen ab 2030 und sp\u00e4ter. <\/p>\n\n\n\n

Die neue Regelung ist jedoch auf in Belgien ans\u00e4ssige Unternehmen, lokale Tochtergesellschaften ausl\u00e4ndischer Organisationen und gebietsfremde Unternehmen beschr\u00e4nkt, die in Belgien mehrwertsteuerlich registriert sind und dort eine feste Niederlassung haben. Eine wichtige Neuerung in diesem Gesetzentwurf ist, dass gebietsfremde Unternehmen elektronische Rechnungen von ihren in Belgien ans\u00e4ssigen Lieferanten f\u00fcr alle inl\u00e4ndischen Lieferungen akzeptieren m\u00fcssen. <\/p>\n\n\n\n
